• Sometimes a simple traffic
citation for speeding may result in
a license revocation. For
example, pleading responsible to
71/55 and paying the fine will
result in a 30 day mandatory drivers
license revocation. See N. C. Gen.
Stat. Section 20-16.1(a). An
attorney may be able to negotiate a
reduction in the rate of speed
charged by the officer and help you
avoid a drivers license revocation.
• Mailing a traffic citation back
to the Clerk of Court with court
costs and fines without hiring an
attorney deprives you of the
opportunity to save substantial sums
of money for auto insurance. For
example, a citation for a stop sign
violation may be mailed back to the
Clerk of Court with the court costs
and suggested fine. However, an
attorney may be able to persuade a
judge to grant a PJC in a case like
this. Failing to obtain a PJC in
a minor traffic matter like this
will result in a 25% premium
surcharge in your auto insurance
over a three year period. These
surcharges are governed by the NC
General Statute and set by the NC
Rate Bureau.
